The decision of the criminal court is not reserved for the case before the civil courts. Non-influence of the civil court from the acquittal of the accused by the criminal court.
The constitutional provision, after all, of three distinct jurisdictions, precludes the existence of a single legal order, in the context of which the judgment of the criminal court, and in particular its irrevocable acquittal, automatically and without any other limit, must be accepted by the civil court, which must reach a result compatible with the acquittal, and, consequently, dismiss the claim for damages of the plaintiff, as otherwise a breach of that single legal order is created.
