The Supreme Court upheld our appeal on all grounds of appeal.

In the light of the foregoing, the contested decision must be set aside in respect of the parties the parties to the present case, in so far as the grounds of appeal have been upheld, and the case referred for further investigation to the same court composed of judges other than those previously adjudicated (Art 580 par.3 of the Code of Civil Procedure) and the insurance company is ordered to pay the appellant’s court fees.
